These Terms of Use (“Terms”) govern your use of the Pitchroom iOS application (“the App”) and the website at https://getpitchroom.app (together, “the Service”). By using the Service, you agree to these Terms.

By downloading, installing, or using Pitchroom, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

3. Description of the Service

Pitchroom is a speaking practice application for iOS. It allows you to record timed speaking sessions, review transcripts, and optionally receive AI-assisted reflections. The app is designed for personal, non-commercial use.

4. Eligibility

You must be at least 13 years of age to use Pitchroom. If you are under 18, you must have parental or guardian consent to use the Service.

5. User Accounts

Pitchroom does not require an account to use its core functionality. Certain features may be managed through your Apple ID and iCloud account in accordance with Apple’s terms of service.

6. Subscriptions and Purchases

Pitchroom may offer auto-renewing subscriptions or one-time purchases through the Apple App Store. The following terms apply:

• Payment: All payments are processed by Apple through your App Store account. We do not collect or store payment information.
• Auto-renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. This can be managed in your App Store account settings.
• Free trials:Any free trial period is offered at Apple’s discretion and according to the terms displayed in the App Store purchase sheet. Unused portions of a free trial are forfeited upon purchasing a subscription.
• Pricing: The price for subscriptions and purchases is clearly displayed in the app and on the App Store purchase sheet. Prices may change; you will be notified before any price change takes effect.
• Refunds:All refund requests are handled by Apple in accordance with Apple’s refund policies. Please contact Apple Support for refund-related inquiries.
• Cancellation: You can cancel your subscription at any time through your App Store account settings. The subscription will remain active until the end of the current billing period.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Use the Service to generate, store, or share harmful, abusive, or inappropriate content.
• Interfere with the operation of the Service or bypass any technical measures.

8. Intellectual Property

Pitchroom, including its name, logo, design, code, and content (excluding user-generated content), is the property of Jonathan Ries / Ries A&AI and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission.

9. User Content

You retain ownership of the content you create using Pitchroom, including audio recordings and session notes. By using the Service, you grant us a limited license to process this content solely for the purpose of providing the Service to you. We do not claim ownership of your content.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your information. By using the Service, you consent to the practices described in that policy.

11. Third-Party Services

The App may use third-party services (such as Apple’s on-device frameworks and cloud infrastructure). Your use of these services is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of these third parties.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. The AI-assisted reflection feature is provided for informational purposes only and does not constitute professional advice.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Jonathan Ries / Ries A&AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This limitation applies even if we have been advised of the possibility of such damages.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or if required by law. Upon termination, your right to use the Service immediately ceases.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory consumer protection provisions of your country of residence. If you have no country of residence in the European Union, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Stuttgart, Germany.
